What can I claim for?

You or anyone in your family can claim for any accident in which you have suffered an injury through no fault of your own. You can claim for damages for personal injury such as an accident or an industrial disease plus financial losses.

How much will it cost?

Win or lose it won't cost you anything.

Are there any time limits?

Yes, 3 years from the date of accident or in the case of an industrial disease 3 years from the date that you first reasonably believed you had a claim. For accidents to children the 3 years begin from their 18th birthday.

Who can make a claim?

Anyone who has been injured - we will consider the merits of all claims however minor the injury.

How much compensation will I receive?

This depends on the seriousness of the injury. In all cases we will obtain a medical report to enable us to put a precise value on the claim.

If I win, do I keep all the compensation?

The agreed compensation figure is the amount you receive. The only potential deduction relates to state benefits that may have been paid as a result of the accident which may have to be repaid to the Government - we will advise you fully on this point.

If I lose, will I have to pay anything?

No, not a penny - and if you win you'll keep 100% of any compensation.

How long will the process take?

Simple claims such as road traffic accidents can be completed within 4-6 months, many claims are completed within 12 months and almost all claims within 24 months - length of cases depends on extent of liability dispute and severity of injuries.

Do I have to do anything myself?

Not a great deal. There may be an initial face to face interview or if you wish this can be avoided by the use of a questionnaire - apart from that all you have to do is go to see a doctor for the purposes of a medical report and deal with any issues arising in correspondence from time to time. In all cases we'll take you through the process step by step and make it easy for you.

Can I claim for treatment?

Yes. If you have paid for any treatments such as chiropractic or physiotherapy we can reclaim this for you. If you have not had any treatment and a need is identified we can also arrange for treatment to be provided at no cost to you.

Who will be handling my case?

Your claim will be dealt with by an experienced personal injury lawyer who will retain the case until it is completed - your claim will not be passed from pillar to post.

Will I have to visit a Leo Abse & Cohen office?

Not necessarily, we can communicate through letters/phone calls/e-mail to suit you.

Will I need a medical examination?

Yes. To ensure that the value of any compensation you receive is fair, a medical report has to be obtained.

Will it take up a lot of my time?

Will I have to go to court and give evidence?

It is possible but highly unlikely, the vast majority of cases are settled successfully out of court.
