Making A Compensation Claim

Initial Contact

When you contact LeoClaims either by telephone or via the website all our advice is totally free. You will speak to an experienced member of our legal team who will ask you for brief details about your accident and the injuries you sustained.  We will then be able to make an assessment of your case and advise you on the likelihood of your claim being successful.

Providing Instructions

We will arrange for one of our specialist team to take your full instructions at a time convenient to you.

Assign Case

Your claim will be assigned  to one of our specialist personal injury solicitors who will handle your case personally from start to finish.  You will be provided with their direct telephone number and e-mail address so you have access to them whenever you need it.

Contacting the Other Party

We will write to the other party (and/or their insurance company) advising of your intention to bring a claim and explaining why we are holding them responsible.  This is called a Letter of Claim.

Gathering Evidence

We will now also start to obtain all the evidence required to support your claim. This may include witness statements, police reports, photographs of injuries and receipts for any costs you have incurred.  It will also assist if you to keep a daily log of your injuries and how they affect your daily life.  

Medical Evidence

Your solicitor will arrange for you to see a locally based medical expert.  The medical expert will provide us with a report detailing the injuries you suffered.  They will also provide a prognosis as to your recovery.  They will advise regarding any ongoing problems caused by the accident and confirm whether any additional treatment is recommended, such as physiotherapy.

Once the medical report has been received we will be in a position to put together a list of all your financial losses. The list may include, for example, a claim for loss of earnings through time off work, medication costs, taxi/rail fares.  Your solicitor will advise you what you may claim for.

Compensation Award

By this time we will normally have heard from the third party with their views on liability (whether they agree that they are at fault or not).  If liability is accepted by the other party, negotiations into settlement will be undertaken with a view to obtaining your compensation as swiftly as possible.  The other party will also be responsible for paying your solicitor's costs.

If agreement cannot be reached it could be necessary to pursue the claim to Court however only a very small number of claims result in a trial at court.
