Medical Negligence

The medical profession's role is to care for patients, provide proper advice and treatment and to look after them to the appropriate standard.

In the majority of cases, medical professions carry out their duties to a high standard but, on occasions, people suffer injury and affects which, if the treatment they had received had been carried out properly, would not have occurred.  Often people feel uncomfortable about making a claim against those who have tried to make them better.  The fact of the matter is that if as a result of treatment from the medical profession which was not up to standard, you have had ill effects then you are entitled to make a claim for compensation.

Compensation Claims for Medical Negligence

Sometimes claims against medical professions are known as "Medical Negligence" claims and sometimes "Clinical Negligence" claims.  The phrases amount to the same thing.  If a patient has suffered injury, financial loss or psychological trauma as a result of clinical/medical negligence then they are entitled to make a claim.

Types of Medical Negligence

There are a number of types of medical negligence claims.  They can include:-

  • Medical accidents, eg an operation is undertaken and a swab is left within the patient who is operated upon.
  • A delay in diagnosis, eg you go to see your GP about some headaches and 18 months later you are told by a Consultant that you have some serious problems.  It might be that had the GP referred you earlier to a specialist, the outcome may have been different.
  • You can suffer injury as a result of surgical errors, eg you may have undergone a hip replacement and after the operation you had significant problems which ought not to have occurred.
  • You  can have birth injury claims, such as the child not receiving enough oxygen, leading to difficulties.
  • You can also have situations where you go into an Accident & Emergency Department and you say you have tripped over and hurt your arm.  The x-ray may say it just a soft tissue injury but later on you find that you have a fracture.  This can lead to further unnecessary treatment had the fracture been spotted in the first instance.
